TERMS & CONDITIONS.
In the event Aston Stuart mobilizes crews to a project site to find that the customer is not prepared to start work and / or receive our crews for project commencement, a mobilization fee of $500 will be charged to the customer.
Electric must be available at the job site for the entire duration of the project. It is the client’s responsibility to provide adequate power. If the customer does not provide adequate power, or if such amenities are not present in the working facility, Aston Stuart will charge the above mentioned mobilization fee. Work will be temporarily halted until the customer has submitted payment for this fee and provided adequate power to the job site.
Due to its nature, during the process of demolition, cleanup, removal and/or installation; accidents such as scratches, dents, breakage, or similar occurrences may occur and no compensation will be demanded by customers, nor liability will be placed upon Aston Stuart LLC or to any of its members.
All furniture, electronics, and glassware must be cleared and removed from the proposed project area(s). Our team is careful when moving items, however, all items are moved at client’s own risk. If items are not moved prior to the proposed project start date, client agrees to assume all risk.
It is the customer’s responsibility to remove all miscellaneous items from the space prior to the project’s commencement (i.e., glass and fragile items, electronics, etc.). Any items that cannot be moved, which may be sensitive to the exposure of dust, such as televisions, should be wrapped or protected by the customer prior to the project’s commencement in order to prevent potential damages. Additional charges will be incurred if Aston Stuart is asked to protect electronic equipment and / or belongings on the customer’s behalf.
It will be the customer’s responsibility to protect or plug any water or waste drains prior to our crew’s arrival so as to prevent concrete dust or product from entering, damaging or warping drains or plumbing fixtures. Any product entrance or contamination of unprotected drain fittings shall not be the responsibility of Aston Stuart.
Our team does not unhook or re-hook any electronic equipment. Our team does not unhook or re-hook any appliances that are hardwired. You will need to hire an electrician to do so. Our team does not unhook or reconnect toilets or plumbing in any nature, gas stoves, ice-makers, gas dryers etc. You will need to hire a plumber to do so.
The project site must have a climate-controlled area to store flooring products. Some flooring materials are very sensitive to temperature and can damage the integrity of the product’s reliability and performance. If the flooring materials are kept and stored in non-temperature-controlled environments by a customer, their agent, superintendent or project manager, it may be grounds for the voiding of any warranty provided. Excess heat, moisture, UV exposure, or elemental exposure will cause materials to degrade and warp, even while they are still packaged.
Job site must be acclimated to normal living conditions at least 3 days prior to the beginning of services and then for the life of the new floor.
We cannot be held responsible for unknown circumstances. Our estimators make every effort to include every item we can foresee. Other such circumstances arise from time to time and you will be notified if any such circumstances arise.
Please note that any installation delays or product damages that result from faulty construction (leaking roofs, plumbing leaks, etc.), natural and environmental exposure (rain, flooding, bugs, rodents, animals, debris from air conditioning vents etc.), or other generally accepted Acts of God outside the control of Aston Stuart shall not be the responsibility of Aston Stuart. Additional work and expense to remedy these uncontrollable circumstances will be billed to the customer and work will be temporarily stopped until those expenses are agreed upon.
Client agrees to not harass, interfere, or give installation advice to Company while they are on the job site. Any job site related issues should be directed towards and handled through the business office of Aston Stuart LLC.
Estimated arrival and finish times are only a guide. Many circumstances during the day can cause our crews to run ahead or behind schedule. You will be notified if this happens.
Some surface scratching or marks may occur on baseboards and/or walls. Touch up is the homeowner’s responsibility.
REFUNDS & CANCELLATIONS.
The Contract will terminate automatically upon completion of services by Aston Stuart LLC. Both parties have the right to terminate this contract at any time. If termination of contract occurs, Customer shall pay Company, Aston Stuart LLC, for work completed at time of termination. If termination of contract for any reason other than completion of services, Company has TEN (10) business days to issue any refunds that may arise resulting from a written claim.
CANCELLATION OF SERVICES POLICY - CUSTOMER MAY CANCEL THIS AGREEMENT WITHOUT PENALTY OR OBLIGATION BY DELIVERING WRITTEN NOTICE TO ASTON STUART LLC BY 11:00PM ON THE DAY OF SIGNING THE AGREEMENT. OTHERWISE, A 20% FEE OF TOTAL PROJECT PRICE WILL BE ASSESSED FOR LATE CANCELLATION.
Under no circumstances will Aston Stuart LLC be responsible for any loss of time, inconvenience, expenses, costs or other consequential damages caused by or resulting directly or indirectly from a problem about which a claim was made.
ASTON STUART LLC OFFERS NO OTHER WARRANTY, EXPRESS OR IMPLIED, THAN THE ONE DESCRIBED HEREIN. NO OTHER REMEDIES SHALL BE AVAILABLE EXCEPT FOR THOSE PROVIDED HEREIN.
